Syed Mustafa Mahdi of Spencer West becomes the first lawyer to successfully implement the Hague Convention on the Civil Aspects of Child Abduction 2017 in Pakistan

Spencer West is proud to share that Commercial and International Dispute Resolution Partner Syed Mustafa Mahdi has, in a groundbreaking case before the Singh High Court in Pakistan, successfully used the Hague Convention on the Civil Aspects of Child Abduction 2017 for the first time ever in the Pakistani jurisdiction.

Syed was representing a father whose child, born in the United States, had been unlawfully transported to Pakistan by their mother, following parental separation. The mother filed for the child’s Pakistani citizenship and Guardianship without the client’s consent.

The Hague Convention, a crucial international treaty, addresses the issue of parental abduction across borders and is a vital framework for resolving these kinds of highly complex and distressing disputes. Syed’s implementation of this treaty, which is deeply rooted in principles of international cooperation, was crucial in resolving the complex custody dispute and ensuring the child’s best interests were met.

Syed’s technical skill and sensitivity played a pivotal role in achieving this positive outcome. The case involved the intricate intersection of international jurisdictions, emphasising habitual residence, foreign judgement enforcement and, most importantly, the prompt return of a minor to the United States. Syed’s strategic legal approach and sensitivity to the nuances of the case were instrumental in achieving justice for his client and his child.

Spencer West is immensely proud of Syed Mustafa Mahdi’s achievement in this historic case, which underscores Syed’s and the firm’s commitment to delivering bespoke legal solutions while navigating sensitive family law matters on the global stage. Across all practice areas and sectors, Spencer West are committed to providing comprehensive client care that prioritises clients and their needs.
